Adam Wienner is an associate with Foley & Lardner LLP. He is a member of the firm’s Business Litigation & Dispute Resolution and Bankruptcy & Business Reorganizations Practices, and Automotive Industry Team. Mr. Wienner’s practice focuses on complex commercial litigation, including contract and business tort law, injunction matters, warranty claims, and successor liability disputes. He has successfully represented clients in the Michigan Court of Appeals, the Michigan Supreme Court, and the Sixth Circuit Court of Appeals. Mr. Wienner also regularly represents clients in litigation and dispute resolution related to bankruptcy proceedings and financially distressed companies.
Mr. Wienner’s representative engagements include extensive work in the following matters:
- Successfully representing both buyers and sellers of goods in numerous injunction proceedings in state and federal court.
- Representing a major automotive manufacturer in a proposed nationwide consumer class action, resulting in the defeat of class certification.
- Representing a multi-million dollar creditor in successive chapter 7 and chapter 11 bankruptcy proceedings filed by judgment debtors. Won dismissal of both bankruptcy cases on grounds of bad faith following trials on the merits.
- Representing an automotive supplier in a fraud and breach of contract action. Won dismissal of a million dollar claim on grounds of opposing party’s discovery violations.
- The defense of former officers and directors from multi-million dollar lawsuits for breach of fiduciary duty and related claims.
- The representation of a liquidating trustee for a subprime automotive lender with over $2 billion in loans under management.
- The representation of multiple major automotive suppliers as special counsel in bankruptcy and in post-bankruptcy litigation.
In 2012, Mr. Wienner was selected for inclusion in the Michigan Super Lawyers – Rising Stars® list for his work in business litigation and bankruptcy & creditor/debtor rights. This prestigious honor utilizes rigorous peer nominations and third party research to identify top lawyers under the age of 40 or who have been in practice for less than ten years. Prior to joining Foley, Mr. Wienner served as a law clerk for the Honorable Avern Cohn, United States District Court Judge for the Eastern District of Michigan.
Mr. Wienner earned his law degree from the University of Michigan Law School (J.D., magna cum laude, 2007), where he was elected to the Order of the Coif and was a contributing editor for the University of Michigan Journal of Law Reform. While in law school, Mr. Wienner participated in Foley’s summer associate program. He received his bachelor’s degree from Harvard University (B.A., magna cum laude, 2004), and currently serves as director of the Harvard Club of Eastern Michigan.
Mr. Wienner is admitted to practice in Michigan, the U.S. District and Bankruptcy Courts for the Eastern District of Michigan, and the Sixth Circuit Court of Appeals.
