Alan R. Poppe is senior counsel at Foley & Lardner and is a member of the firm’s Business Litigation & Dispute Resolution Practice. His practice focuses on general and complex commercial litigation, with an emphasis on intellectual property litigation, franchise litigation, business torts, and unfair trade practices.
Among other clients, Mr. Poppe has represented franchisors with respect to such diverse issues as breach of contract, fraud, trademark infringement, franchise termination and enforcement of post-termination covenants, vicarious liability, registration and disclosure violations, enforcement of system standards, implied covenant of good faith and fair dealing, consumer fraud, and other disputes. In addition, he has assisted his clients with traditional bankruptcy issues, including objections to discharge and fraudulent transfer litigation.
Mr. Poppe has wide-ranging experience litigating at both the trial and appellate levels in both federal and state courts. Recent notable representations include:
- Winning summary judgment in favor of multi-state health care system in class action uninsured patient litigation
- Successful defense of client franchisor against claims for breach of the implied covenant of good faith and fair dealing and violations of state consumer fraud statutes
- Obtaining permanent injunctions for client franchisor against former licensees in trademark enforcement actions
- Successfully enforcing non-compete agreements on behalf of client franchisor against former franchisees
- Representing Fortune 500 software company in numerous lawsuits against counterfeiters
- Obtaining appellate victory upholding forum selection clause on behalf of international music distributor
Mr. Poppe earned his J.D., summa cum laude (1999), from the University of Miami School of Law. While in law school, Mr. Poppe was a member of the law review and represented the University of Miami in the National Moot Court Competition in Atlanta, Georgia. He received his bachelor’s degree from Michigan State University (B.A., 1988).
Mr. Poppe is a member of the Dade County Bar Association and the Forum on Franchising, American Bar Association. He is admitted to practice in the State of Florida, the U.S. District Courts for the Southern, Middle and Northern Districts of Florida, and the U.S. Court of Appeals for the Eleventh Circuit.
