Elizabeth Elson is of counsel with Foley & Lardner LLP where her practice focuses on counseling clients on federal and state health care legislation and reimbursement and compliance issues arising under government programs such as Medicaid and Medicare. She is a member of the Health Care Industry Team.
Ms. Elson worked in the Los Angeles office until 2008, when she left as a partner to work as in-house counsel at Amgen in Thousand Oaks, California. She returned to Foley in 2011.
Ms. Elson’s experience includes advising clients on the development and operation of Medicaid demonstration projects as well as drafting and analyzing Medicaid legislation. She has also assisted clients with internal and government investigations and False Claims Act litigation involving issues such as Medicare and Medicaid billing practices and alleged Anti-Kickback Statute and Stark Law violations. She has advised clients, including durable medical equipment suppliers, dialysis companies, health systems, hospitals, county health departments and hospital associations on a variety of reimbursement, compliance, contractual and operational issues. Ms. Elson also advises clients on operational, compliance, and reimbursement issues related to the 340B Drug Pricing Program.
While at Amgen, Ms. Elson advised its compliance department on issues such as state law reporting requirements, internal investigations and development of compliance policies. Ms. Elson also counseled her clients on regulatory, operational and contractual health care issues related to the marketing and promotion of products, including fraud and abuse issues, Food and Drug Administration advertising and promotional labeling issues and anti-trust issues. Additionally, she provided legal guidance to commercial and research and development clients on Risk Evaluation and Mitigation Strategy (REMS) program issues.
Ms. Elson received her J.D. degree from the University of California, Los Angeles (1999), where she served as a symposium editor for the UCLA Law Review. Ms. Elson was a judicial extern with the Honorable William D. Keller. She earned her B.A. degree, magna cum laude, in psychology from Tufts University (1996).
