Foley acted as lead counsel on behalf of a secured creditor in connection with a multi-day evidentiary hearing on that creditor's motion to dismiss or in the alternative, for relief from stay, in a multi-million dollar single asset real estate case involving a shopping center. The case was dismissed at the conclusion of trial in 2011. Reconsideration was denied and no appeal was taken.
