Kelly M. Weiner is an associate with Foley & Lardner LLP and a member of the Trademark, Copyright & Advertising Practice. Ms. Weiner provides counsel on a wide range of intellectual property issues in connection with brand management, contract drafting and negotiation, and intellectual property-related transactions.
Ms. Weiner regularly advises clients on and ensures compliance with trademark laws, copyright laws, unfair competition laws, online consumer privacy and protection laws and applicable internet law. She provides strategic counseling on trademark clearance, selection and use, and prosecution and enforcement issues relating to trademarks, trade dress, copyrights, trade secrets, and domain names. Ms. Weiner has successfully negotiated the resolution of many trademark, trade dress, copyright and domain name disputes.
Ms. Weiner has extensive experience in contract negotiation. She frequently assists clients with licensing agreements, vendor agreements, agreements pertaining to promotions and promotional events, and sponsorship agreements. In addition, she guides clients in the strategic development and negotiation of intellectual property-related transactions and performs thorough due diligence of intellectual property assets and related agreements in connection with auditing, licensing, acquisition, stock transfers and mergers.
Ms. Weiner's practice includes clients and companies of all sizes, from Fortune 500 corporations to start-ups and not-for-profit organizations. Some of the representative industries she has served include: apparel and fashion; charitable services; consumer products and electronics; entertainment; financial services; food, beverage and restaurants; media; medical devices; personal care products; and publishing.
Prior to joining Foley, Ms. Weiner was an associate with Morgan, Lewis & Bockius LLP.
Ms. Weiner received her J.D. from Emory University School of Law in 2004. She received her B.A. from the University of Rochester in 1999.
Ms. Weiner is admitted to practice in New York. She is a member of the International Trademark Association, The Copyright Society of the USA, and the New York State Bar Association – Committee on International Intellectual Property Law.
