David B. Goroff
Partner

David B. Goroff is a partner with Foley & Lardner LLP. He is national chair of the firm's Appellate Practice. He is also a member of the firm's Bankruptcy & Business Reorganizations and Antitrust Practices. He has substantial trial experience and an emphasis in appellate litigation, bankruptcy litigation, and antitrust litigation and counseling.

Mr. Goroff has extensive experience representing clients before state and federal appellate courts and the United States Supreme Court.

He represents entities in all aspects of the bankruptcy litigation process. Selective representations include the plan administrator in a multibillion dollar information services bankruptcy; In re Bridge Information Systems, including overseeing more than 400 litigation matters relating to preferences, claims and other issues; the Liquidating Trustee in appellate and other matters In re Farmland, Inc.; the bankruptcy of a large agricultural cooperative; the Village of Rosemont, Illinois as petitioning creditor in the successful petition for involuntary bankruptcy of a riverboat gambling operation In re Emerald Casino, Inc.; claimants in a mass tort bankruptcy in In re Dow Corning; a consortium of the nation's major airports in In re TWA and In re UAL Corp.; the liquidating trustee in a large telecommunications bankruptcy, In re USN; a hotel owner in adversary litigation In re Northwest Airlines, Inc., a Securities Investor Protection Act Trustee investigating fraud and a Ponzi scheme that brought down a brokerage house in In re Old Naples, Inc.; the Chapter 7 trustee in a large manufacturing bankruptcy, In re Madison Management Systems, Inc.; the Chapter 7 trustee in a large retail bankruptcy, In re Ben Franklin Retail Stores; the Chapter 11 trustee in the bankruptcy of a major conglomerate, In re Grabill, Inc.; a secured lender in In re Sabratek, Inc.; and a potential purchaser of assets in In re Safety-Kleen. He also advises and counsels clients on bankruptcy alternatives and on strategies for reorganizing and resolving matters with creditors.

His antitrust counseling assignments include preparing antitrust compliance programs for clients, structuring joint ventures, advising clients of the application of antitrust laws to previously regulated industries, and assisting clients with the merger review process before the Federal Trade Commission and the U.S. Department of Justice. This has included the preparation of Hart-Scott Rodino filings, white papers, and other materials in response to agency "Second Requests" for information. Mr. Goroff is active in a variety of professional groups including the American Civil Liberties Union of Illinois, for which he serves on the board of directors and as a member of the executive committee. He also has frequently acted as cooperating counsel for the agency. Mr. Goroff has served as vice chair of the American Bar Association's Antitrust Section and also as a member of the Books and Treatises Committee. He has served as an adjunct professor for the University of Illinois Law School and Chicago-Kent College of Law and also as an instructor for the Illinois Institute of Continuing Legal Education and the National Institute for Trial Advocacy.

Mr. Goroff is a graduate of Columbia University's Law School (J.D., 1985), where he was a Harlan Fiske Stone Scholar and a notes and comments editor of the Columbia Law Review. He received his bachelor's degree from the University of Illinois (B.A., summa cum laude, 1982), where he was elected to Phi Beta Kappa. Following law school, Mr. Goroff served as a law clerk for the Hon. Richard D. Cudahy of the U.S. Court of Appeals for the Seventh Circuit.

Mr. Goroff is a member of the American College of Trial Lawyers and the American Institute of Appellate Lawyers. He is admitted to practice in Illinois, the U.S. District Courts for the Northern District of Illinois, Central District of Illinois, the Eastern District of Michigan, the United States District Court for the District of Colorado, the United States District Court for the Western District of Wisconsin, the U.S. Courts of Appeals for the Second, Third, Sixth, Seventh, and Eighth Circuits, and the U.S. Supreme Court.

Mr. Goroff was selected for inclusion in the 2005, 2006, 2008, 2009 and 2010 Illinois Super Lawyers® lists.* He was also named a 2007, 2008 and 2009 Illinois "Leading Lawyer" by the Leading Lawyers Network.*
