Jason Menges is a partner with Foley & Lardner LLP. He is a member of the Business Litigation & Dispute Resolution and Intellectual Property Litigation Practices and the Automotive Industry Team. His practice focuses on the resolution of complex commercial disputes, intellectual property counseling and litigation, trade secrets and restrictive covenant counseling and litigation, and antitrust and distributorship counseling and litigation. He also regularly represents automotive suppliers and customers in troubled supplier workouts and related litigation. Mr. Menges represents clients in state and federal trial and appellate courts, and in arbitration, mediation and alternative dispute resolution services. He also counsels and represents clients in administrative adjudications, regulatory investigations and hearings. Mr. Menges has represented clients in the automotive, insurance, health care, securities, finance, banking, manufacturing, technology, and computer industries in several states. Mr. Menges was selected for inclusion in the 2008 and 2009 Michigan Super Lawyers – Rising Stars® lists for his work in the field of business litigation. Mr. Menges serves on the Rochester College board of trustees and the EKS Services board of advisors. His representative cases include: - Obtaining a preliminary injunction in a case involving breach of noncompete agreement in the sale of a business
- Obtaining a temporary restraining order in a case involving misappropriation of trade secrets in the automotive industry, against former employees who developed highly-confidential wireless technology
- Obtaining a favorable settlement for a temporary staffing industry client in connection with a motion for preliminary injunction for misappropriation of trade secrets and breach of a noncompete agreement, after a three-day evidentiary hearing
- Obtaining a temporary restraining order in a case involving misappropriation of trade secrets and breach of a noncompete agreement, relating to departure of key sales person in plastics business
- Obtaining a highly favorable settlement in a case involving misappropriation of trade secrets, breach of a noncompete agreement, violation of computer fraud and abuse act, and breach of fiduciary duties, relating to the en masse departure of key employees
- Obtaining summary judgment in connection with a damages claim totaling approximately $50 million, relating to an automotive breach of contract dispute
- Obtaining summary judgment in connection with a $2 million breach of contract claim asserted against an automotive client for termination of a supply relationship
- Obtaining numerous temporary restraining orders and preliminary injunctive relief for automotive clients threatened with the potential shutdown of their operations based on supplier breaches of contracts
- Representing an automotive client in a $65 million breach of warranty claim involving the supply of defective automotive component parts
