Rachel Kramer is senior counsel with Foley & Lardner LLP. Her practice spans a range of commercial litigation matters, including commercial real estate financing and secured lender-related matters, health care provider disputes, SEC and other government investigations, and trade secret/noncompete matters. Ms. Kramer has substantial experience litigating and arbitrating such matters in the federal and New York state courts and before arbitration tribunals, including complex e-discovery, depositions, motion practice, trial preparation and alternative dispute resolution. She has also represented clients in SEC and other government investigations. Ms. Kramer is a member of the firm’s Business Litigation & Dispute Resolution and Trade Secret & Noncompete Litigation Practices.
Ms. Kramer's representative matters include:
- Arbitration of a multimillion-dollar medical payment and reimbursement dispute on behalf of a major medical equipment provider
- Defense of one of the nation's largest Medicare Administrative Contractors (MAC) in a False Claims Act/whistleblower action
- Representation of witnesses in various SEC investigations, including, among others, matters relating to mortgage-backed securities and to accounting practices related to sale of software
- Defense of trade secret and non-compete claims against hedge fund managers, a software engineer, and a management consultant
- Commercial mortgage foreclosure litigation relating to properties in New York
In 2012, Ms. Kramer was selected for inclusion in the New York Super Lawyers - Rising Stars® list.
Ms. Kramer received her J.D. with honors from The George Washington University Law School (2005), where she served as a senior articles editor for the Public Contract Law Journal. She earned her A.B. in psychology, cum laude, from Harvard University (1999).
She is admitted to practice in New York and before the U.S. District Courts for the Southern and Eastern Districts of New York.
