Scott Callen is a partner with Foley & Lardner LLP and a member of the Labor & Employment Practice. He concentrates his practice on labor and employment law, civil litigation, corporate counseling, administrative and commercial litigation. He is also a member of the firm’s Hospitality, Resort & Golf and Food & Beverage Industry Teams.
Mr. Callen has extensive experience with employment laws and advises clients on discrimination avoidance, sexual harassment, drug testing, workplace accommodations, investigations, independent contracting arrangements, employee leasing, employee handbooks, commissions, immigration, unemployment compensation, and compliance with the Fair Labor Standards Act, Family Medical Leave Act, Americans with Disabilities Act, Title VII and various other federal and state employment law matters. He has extensive experience defending international, national, regional, and local companies in federal and state discrimination, retaliation and harassment matters, unfair competition, worker’s compensation retaliation, business-related torts, and administrative and commercial litigation matters. Mr. Callen has experience in employment and benefit implications related to the Affordable Care Act. He also has experience in defending companies in overtime violation investigations by the Department of Labor, litigation related to overtime and unpaid wages, and his practice group has vast experience and resources to defend FLSA, unpaid wages and overtime collective action cases.
Mr. Callen received his J.D., cum laude, from Florida State University College of Law (1998) and a bachelor's degree, cum laude, from Florida State University (1995).
Mr. Callen recently authored a chapter entitled, “Key Components of Defending Employer Clients in Litigation,” of Inside the Minds – Strategies for Employment Litigation, published by Thomson Reuters/Aspatore (2012). He is a frequent speaker on employment law topics such as technology and privacy issues in the workplace, Fair Labor Standards Act investigations, writing and applying employment handbooks in Florida, effective methods for employee discharge and documentation, and sexual harassment avoidance.
Mr. Callen was selected as a 2005, 2006, 2007, 2008 and 2009 Legal Elite™ by Florida Trend magazine. Less than 2% of Florida attorneys receive this designation.
