Scott R. Kaspar is senior counsel with Foley & Lardner LLP, where he focuses his practice on intellectual property litigation and has significant experience with patent litigation. Mr. Kaspar is a member of the firm’s IP Litigation Practice. Recent notable decisions include:
- Winning summary judgment of noninfringement based on patent exhaustion for private label food manufacturer. Keurig, Incorporated v. Sturm Foods, Inc., No. 10-cv-00841-SLR (D. Del. Sep. 13, 2012);
- Obtaining sanctions and over $140,000 in attorneys’ fees stemming from defendants’ failure to adequately search for and produce relevant documentation. Sloan Valve Co. v. Zurn Indus., Inc. et al., No. 10-cv-00204 (N.D. Ill. May 23, 2012);
- Winning summary judgments of noninfringement for major bank in patent litigation. Ronald A. Katz Tech. Licensing, L.P. v. U.S. Bancorp et al., No. 07-cv-02360 (C.D. Cal. May 1, 2009); and
- Dismissing counterclaims and affirmative defenses in patent litigation involving dual flush valves. Sloan Valve Co. v. Zurn Indus., Inc. et al., 712 F. Supp. 2d 743 (N.D. Ill. 2010).

- Serving as Liaison Counsel on behalf of large financial institutions and retailers in a multidistrict patent litigation involving call center IVR systems. In re Katz Interactive Call Processing Patent Litigation, No. 07-ml-01816 (C.D. Cal.);
- National emergency response organization in dozens of disputes with unauthorized users of the Red Cross’s emblem, including several domain name disputes. American Nat’l Red Cross v. Mr. Kaspar is licensed to practice in the states of Illinois, Iowa, and California and before the United States Patent and Trademark Office. He is a member of the bars of the U.S. Court of Appeals for the Federal Circuit, the U.S. District Court for the Northern District of Illinois, the U.S. District Court for the Southern District of Iowa, and the U.S. District Court for the Central District of California.
As a registered patent attorney, Mr. Kaspar has counseled clients concerning patent matters with respect to a wide array of technologies, including communications; control systems and electronic devices; automotive and vehicles; banking and finance; hydroforming processes; food processing; consumer appliances and products; farm equipment and agriculture; and software and computer-implemented methods.
In addition to his legal work for the firm, Mr. Kaspar is deeply committed to pro bono service and has assisted legal services such as the Chicago Volunteer Legal Services and the Lawyers for the Creative Arts. He also volunteers his time as president of a master homeowners association involving nine buildings in downtown Chicago.
Mr. Kaspar graduated from Drake University Law School (2003), where he was a member of the Drake Law Review and served as president of his law fraternity. He holds a Bachelors of Science in mechanical engineering from the University of Illinois at Urbana-Champaign (1998), where he participated in Army ROTC and was president of his undergraduate fraternity. Prior to attending law school, Mr. Kaspar worked as a mechanical engineer in the valve industry.
A member of the American Society of Mechanical Engineers since 1994, Mr. Kaspar also is a member and participant in the American Bar Association, the American Intellectual Property Law Association, the Illinois State Bar Association, the Iowa State Bar Association, the California Bar Association, the Intellectual Property Law Association of Chicago, and the Chicago Bar Association.
