At Foley, we understand the business side of the challenges and risks posed by potential and actual lawsuits, and have the skills and experience to win cases. With litigators practicing nationwide, Foley has one of the largest and most comprehensive litigation departments in the country. The Litigation Department is the firm's largest department and has a strong presence in all of the firm's offices.

Proven Experience in the Courtroom
Our trial attorneys represent corporations in nearly every industry and handle some of the largest and most complex commercial lawsuits and arbitrations for major domestic and international clients. Our litigators provide complete state and federal trial and appellate representation, arbitration, mediation, and alternative dispute resolution services. We also counsel and represent clients in administrative adjudications and in regulatory investigations and hearings. Our trial lawyers have proven experience with hundreds of cases tried to verdict or arbitration award in nearly every state in the United States. This experience gives our attorneys the ability to review a case and plan the most efficient strategy to achieve each client's business objectives.

Experience in Alternative Dispute Resolution
We recognize that an early, prudent business settlement is usually better than a prolonged war of attrition, no matter how successful. Where appropriate, we advocate the use of alternative dispute resolution procedures as tools to bring prompt and efficient resolution to complex litigation and to reduce the costs and delays often associated with commercial litigation.

Litigation Support Services
As a value-added service, our Litigation Department employs nationally recognized Litigation Support Services coordinators who are strategically located throughout the country. They are available to consult with or assist both our attorneys and clients in case strategy, document production, electronic data processing, demonstrative evidence, trial presentation, and training.

Case Management and Budgets to Help Avoid Surprises
Our litigators understand and respect our clients' strategy and goals, and emphasize case management, risk evaluation analyses, and frequent communications to meet those goals. Foley trial lawyers follow a case management approach with a strategy dependent upon the probability of success, the ramifications of the outcome on our clients' image, the likelihood of future litigation and the cost.

We embrace matter budgeting because we know that clients need to predict, as much as possible, the costs of the litigation. Our budgeting program enables each lawyer to use American Bar Association (ABA) task codes to easily create and maintain a budget for every matter. If time charges are recorded using the ABA task codes, we can give the client real-time status reports of expenses against budget, broken down for each phase of the case. The goal is to avoid surprises.
