Foley has an extensive and varied Antitrust Practice. Our team of attorneys provides a range of services — from day-to-day counseling to multi-district class action litigation. At Foley, we understand that our clients seek practical, cost-effective solutions to their business problems. Therefore, we strive to deliver a unique combination of experience, cost-effective options, and creative but prudent problem solving to our clients. An Antitrust Practice Based on Extensive Experience
The Antitrust attorneys at Foley bring diverse experience to our clients. This experience ranges from handling high-profile and multi-billion dollar claims to smaller matters that we know are just as critical to a client. In addition, we represent international clients with U.S. as well as foreign antitrust issues that arise from the clients' business operations wherever located.
Our team is comprised of trial lawyers, business counselors, and former government antitrust lawyers, including a former acting assistant director of the Federal Trade Commission's (FTC) Bureau of Competition, and a former antitrust counsel to the House Judiciary Committee.
We recognize that effective antitrust counseling requires an understanding of our clients' goals and objectives. To that end, our Antitrust attorneys work as integral parts of Foley industry teams to bring knowledge of the context of the clients' needs — and not just an understanding of the law — to the business issues confronting our clients.
Agency Experience
We deal regularly with the FTC, the United States Department of Justice's (DOJ) Antitrust Division as well as the antitrust departments of many state attorneys general and the European Commission (EC). Our experience with these agencies includes:
Pre-merger notification/Hart-Scott-Rodino and international merger filing issues
Civil investigative demands
Requests for advisory opinions, competition law exemptions, and/or business review letters
Unfair trade or advertising practices
Agency antitrust investigations
Antitrust Compliance
We believe that antitrust compliance means delivering programs that engage and effectively identify and educate the target audience about antitrust risks and solutions. Part of this includes designing and implementing effective and comprehensive compliance programs. The other part involves our commitment to assist clients in implementing ongoing training and counseling.
We have worked with clients to help tailor their compliance programs to their specific needs — an approach that may include traditional lectures, use of computer software modules, training workshops that leverage technology to deliver Internet-based seminars, or even training videos that star the client's key personnel.
