“Direct to Consumer: Legal and Regulatory Issues for Telehealth Entrepreneurs”

Foley Partner, and Chair of the firm’s national Telemedicine & Digital Health Industry Team, Nathaniel Lacktman, will be a speaker at the American Telemedicine Association’s Annual Conference and Expo on April 14-16, 2019 in New Orleans. His presentation is titled, “Direct to Consumer: Legal and Regulatory Issues for Telehealth Entrepreneurs.”

We are on the brink of massive changes in the delivery of health care services. An unprecedented wave of new modalities, applications, and technologies are being unleashed into the marketplace that will redefine the consumer experience—and demand for virtual care services is steadily increasing. As the system evolves and consumers embrace their power to gauge, understand, and manage their health through telehealth, it’s up to providers and delivery systems to adapt to make great choices for their clients.

“Making Telehealth an Essential Component to Care Delivery for Older Adults”

Foley Partner Nathaniel Lacktman, and Special Counsel Kyle Faget, members of the firm’s national Telemedicine & Digital Health Industry Team, will be speakers at the American Telemedicine Association’s Annual Conference and Expo on April 14-16, 2019 in New Orleans. Their presentation is titled, “Making Telehealth an Essential Component to Care Delivery for Older Adults,” will take place on Sunday, April 14th from 8:00 – 11:30 a.m.

As the country’s population ages, older adults have higher expectations for the quality and caliber of Post-Acute and Long-Term Care (PALTC). We cannot ignore this population. Post-acute care accounts for more than $60 billion annually and is expected to increase dramatically. Telehealth technologies should be an obvious choice to allow older adults to age in place and bring high-quality medical providers to the patient’s home or long-term care residence. And yet, few PALTC providers use telehealth in their service models. These technologies can be used to proactively address the needs of residents within these communities by improving access to care and decreasing unnecessary transfers to hospitals or more acute settings.

To address low telehealth adoption in PALTC settings, The West Health Institute convened leading telehealth organizations (e.g., Cobble Hill LifeCare, Sharp, Avera eCARE, Curavi Health, AMDA, AGS, CCHP, UCSD Health and Foley & Lardner, LLP) to create an approach to increase telehealth adoption through understanding best practices.

The result will be offered in this hands-on workshop, where experts will illustrate the value proposition of implementing telehealth in PALTC and give concrete strategies for developing successful telehealth programs. The models are specifically tailored for the PALTC environment, but the lessons learned in this interactive workshop are transferable to many settings in the healthcare continuum.

Led by a multidisciplinary team, attendees will have a unique experience interacting and learning from leading experts. In addition, all attendees will receive a copy of West Health’s new guidebook, “A Practical Guide: Implementing Telehealth in Post-Acute & Long-Term Care.”

Upon completion of the workshop, participants will be able to:

  • Understand the utility and importance of conducting needs and organizational readiness assessments when implementing telehealth programs.
  • Articulate the value proposition, financial, reimbursement, and legal model considerations for implementing telehealth in delivery models specific to older adults, such as PALTC.
  • Explain the various operational and staffing strategies to leverage remote medical provider expertise coupled with on-site extenders and nurses to create service offerings that are both high-quality and cost-effective for PALTC settings.

“Successfully Navigating the CHQI Telemedicine Accreditation Program Application & Review Process”

Foley Of Counsel Emily Wein will also be speaking on Sunday, April 14th, at the in-person pre-conference workshop “Successfully Navigating the CHQI Telemedicine Accreditation Program Application & Review Process” from 8:00 - 11:30 a.m. The workshop will illustrate the value of telemedicine accreditation, review and interpret each of the accreditation standards, and provide tips for developing a successful accreditation application.

Upon completion of the workshop, participants will be able to:

  • Describe the accreditation process and related milestones for applicant organizations.
  • Understand the Telemedicine Accreditation Program’s Standards and Guidelines and how the Standards are utilized by application reviewers.
  • Recognize appropriate evidence as required by established compliance indicators for each of the accreditation standards.
