The Impact of AT&T v. Microsoft on Infringement Under United States Patent Law

Infringement of an unexpired United States patent occurs when there has been the unauthorized making, using, or selling of the claimed invention within the United States. The law of infringement differs when dealing with American patents in other countries. In general, a party is not liable for infringement when patented material is made and sold in foreign countries. An exception can be found, however, in §271(f) of the Patent Act.
