Foley Senior Counsel Nathaniel (Nate) Lacktman, member of the Health Care Industry Team, will be a speaker at an upcoming American Health Lawyers Association (AHLA) Web conference on Monday, November 28, 2011. Mr. Lacktman's presentation is titled, "Hot Topics in DMEPOS Compliance: New Supplier Standards, Re-enrollment and Appeals." 

Since the release of new and revised supplier standards, suppliers of Durable Medical Equipment, Prosthetics, Orthotics and Supplies (DMEPOS) continue to face compliance challenges with their operations, enrollment (and re-enrollment), and marketing to beneficiaries. To further complicate matters, the Centers for Medicare and Medicaid Services (CMS) issued a number of sub-regulatory FAQs and a proposed rule revising some of the newly-issued supplier standards. As a result, DMEPOS suppliers encounter complications with implementing and understanding the new enrollment processes and supplier standards, particularly the rules regarding telemarketing and beneficiary marketing.

The presentation will educate health care counsel on procedures and practices to help their DMEPOS clients ensure compliance with the new standards and survive heightened Medicare enrollment scrutiny. In addition, the presentation will address the implications for failure to comply with the new supplier standards and enrollment processes, as well as offer recommendations on appealing such terminations and revocations.

Serving as a public resource on selected healthcare legal issues, AHLA educates members, their clients and local communities on important health law issues.
