Foley Partner and chair of the Securities, Commodities & Exchange Regulation Practice George Simon was quoted in an article that appeared on Markets Media on September 29, 2009 titled “SEC Probes Securities Lending.” Simon discusses stock lending, remarking that although it is a necessary part of short selling activity, stock lending is a practice without any real transparency that has led to criminal proceedings as a result of kickbacks and civil litigation caused by failed stock loan programs.
