Gray Quoted on False Marking Cases

Foley Associate Justin Gray was quoted in an article that appeared on The National Law Journal on April 5, 2010 titled “Federal Circuit Ruling Sparks Surge of Patent Whistleblower Suits.” Gray discusses the wave of whistleblower suits following a Federal Circuit decision that increased the potential fines in so-called "false marking" cases. He notes that inventors and competitors who allege that they have been harmed by false marking can easily search through online patent databases such as the USPTO website to determine if a patent is expired and quickly file a false marking claim.
