In an effort to fight prescription drug abuse, the Texas Department of Public Safety maintains Prescription Access Texas. CBS-DFW interviewed Gardere Partner Peter S. Vogel for insight on the legal implications of the database which shows registrants the doctors and patients who prescribe, fill and buy controlled substances.
"It's possible that a patient can claim that it's an invasion of their privacy under the Constitution's Fourth Amendment," Mr. Vogel said. "Are they going to then have a drug raid on that person's home? Are the police going to come and seize the drugs? It's not real clear what would happen with all that."
