Gardere Client Files Suit for Insurance Company's Failure to Reimburse Defense Costs

Law360 reported on Shirley Martinez's inquiry to the Texas Supreme Court asking it to abandon the "baseball rule" and revive her case against the Houston Astros. The "baseball rule" holds that spectators assume the risk that they might be injured during a game. Ms. Martinez, who was hit in the face by a batted ball, argues that the rule provides an unfair and unnecessary shield to stadium owners.
