Overly Quoted on Data Security

Partner Michael Overly was quoted in a Bloomberg Business of Law article, “Cybersecurity Lawsuit Poses Vendor Liability Question,” on January 20, 2016. The article discussed a lawsuit in which Affinity Gaming is suing forensic data security investigator Trustwave Holdings Inc. for fraud after they failed to proscribe appropriate remedial measures for Affinity’s data breach. The lawsuit looks at whether a security vendor can be held liable for not ensuring the complete safety of a company. Overly was quoted saying, “Absolutely, no one on earth can come in and look at a system and say ‘yeah, you’re 100 percent secure.’ The only way to be secure is if you disconnect all the computers.”
