Partner Greg Neppl is quoted in a PaRR article, “Time Warner/AT&T merger ‘more harmful’ than NBC/Comcast, officials say,” about the Justice Department’s stated reasons given in a media call for challenging the proposed merger of AT&T and Time Warner.
Neppl said the question raised by the department’s reference to company documents as an example of the possible harms posed by the proposed merger is whether the documents are being taken in context. “Sometimes the snippets they put in the press releases are all they have,” he said.
Neppl also said it’s hard to say at this point whether the case represents a populist shift by the Trump administration or a one-off matter. “Makan [Delrahim, leader of the department’s antitrust division] certainly appears open to new arguments and theories,” he said.
