Hunter Comments on New Guidance for Computer Patents

Partner Paul Hunter was quoted in a Law360 article, “Computer Patents to Get Closer Look With USPTO Guidance,” about the U.S. Patent and Trademark Office’s new guidance to examiners on how computer-related patent applications should be written to avoid being rejected.

Hunter said setting out the standards in a single document should provide more uniformity among examiners. “These guidelines are making pretty clear that when you’re drafting claims, particularly in the computer software area, you need to make sure that the claims are not functional claims,” he said.
