Foley Partner John Douglas authored an article that appeared in TLNT on November 3, 2011 titled "Occupy [Insert City] Is Coming – Are You Ready If Your Employees Get Involved?" Douglas discusses "protected concerted activities" such as the general strikes that have recently taken place in California, and whether or not these activities qualify for protection under the National Labor Relations Act. He states that the National Labor Relations Board does not consider the general strikes to constitute egregious misconduct, adding that employers who terminate or discipline employees for supporting or participating in general strikes may face legal repercussions and should weigh their legal options carefully.
