Overview
Trevor Clark is an associate and intellectual property litigation attorney with Foley & Lardner LLP. He is based in the firm’s Salt Lake City office where he is a member of the Intellectual Property Litigation Practice Group.
Trevor is an experienced intellectual property (IP) litigator whose practice is informed by his patent and trademark prosecution and portfolio management experience. As an IP litigator, he represents clients in patent, trademark, trade dress, trade secret, false advertising, and unfair competition matters before federal district courts and the International Trade Commission (ITC).
Trevor’s IP counseling experience includes prosecution management, portfolio maintenance, due diligence, licensing, opinion preparation, and strategic planning for implementation of IP protection, enforcement, and monetization.
Clients benefit from Trevor’s insight from his former role as Associate General Counsel and Privacy and Security Officer of a healthcare technology and communication company. In this role, Trevor advised on the expansion and protection of the organization’s IP portfolio and focused on risk mitigation related to IP, privacy, security, compliance, marketing, advertising, and employment. He also drafted vital company documents, negotiated agreements, and served as the point of contact for investors. His compliance responsibilities included the creation, implementation, and enforcement of the organization’s Health Insurance Portability and Accountability Act (HIPAA) privacy program; training employees on compliance-related issues; and the investigation of privacy and security incidents.
Representative Matters*
- Represented a prominent active lifestyle company in over 75 successful utility and design patent enforcement matters, recovering damages for patent infringement and obtaining permanent injunctions to prevent future infringement.
- Defended a leading home automation and security company in an International Trade Commission investigation related to allegations of infringement of smart video doorbell and camera technology and secured a summary determination order from the administrative law judge invalidating each of the patents asserted against the company’s products.
- Represented a well-known sports and healthcare products company in enforcement of trade dress rights resulting in favorable settlement including the modification of competitor packaging.
- Conducted IP due diligence for a multinational corporation and technology company in two mergers and acquisitions including a seven-figure acquisition encompassing more than 1,000 IP assets.
