Alan Ouellette is a business litigation lawyer with Foley & Lardner LLP. He is a senior counsel in the firm’s Business Litigation and Dispute Resolution Practice.

Alan is lead counsel for clients in California state court and federal courts across the country. Alan has also served as lead counsel in over 100 arbitrations. He has extensive trial experience, including first chair experience in trials in federal court and arbitration.

Alan’s practice focuses on guiding clients through complex business disputes and litigation with significant, and potentially catastrophic, exposure, including class actions, Judicial Council Coordination Proceedings (JCCPs), and mass tort actions. Alan routinely represents both plaintiffs and defendants, which has provided him with unique insight into formulating and implementing winning case strategy.

Alan advises and guides a wide range of clients in the insurance and health care industries, as well as clients requiring expertise in managing and successfully resolving complex business and commercial disputes across sectors.

  • Obtained defense verdict for client in unfair business practices lawsuit.
  • Obtained denials of class certification and dismissals of putative class claims for clients across various industries.
  • Obtained certification of state and nationwide classes in federal court and certification of class action in state court.
  • Represented health care industry clients in over 100 matters in state and federal court and arbitration, including verdicts in favor of clients following trial.
  • Managing portfolio of over 300 lawsuits coordinated in a JCCP.
  • Represented financial services client in mass tort lawsuit brought by over 50 plaintiffs.
  • Principal author of numerous briefs in appellate proceedings resulting in published decisions, including Advanced Women’s Health
  • Center, Inc. v. Anthem Blue Cross Life and Health Insurance Company (lead case: DB Healthcare, LLC v. Blue Cross Blue Shield of Arizona), 852 F.3d 868 (9th Cir. 2017) and Owino v. CoreCivic, Inc., 60 F.4th 437 (9th Cir. 2022).
