We regularly advise clients on such pricing issues as suggested retail pricing, co-op restrictions on advertised price, below-cost pricing, price and locality discrimination, and rebate programs. Our experience with the Robinson-Patman Act — including experience litigating price discrimination claims — provides a framework for advising clients on their pricing programs. We also work with clients to identify their strategic channel objectives and, together with members of our Distribution & Franchise Practice, to assess the use of non-price restraints to further clients’ business interests and create a stronger distribution system.
