Foley Senior Counsel Peter McLaughlin was quoted in an article that appeared in the May 31, 2010 issue of American Medical News titled “AMA leads suit to block FTC rule telling doctors to police ID theft.” McLaughlin discusses a suit filed by organized medicine to block the FTC from subjecting physicians to “red flag” identify theft rules, recommending that each practice evaluate its individual risk for identity theft and develop a customized plan to address potential fraud occurrences. He adds that health care providers must be careful to remain in compliance with custom policies, noting that the FTC shows little lenience for providers who develop a policy but do not comply with it.
