Foley has a long history of representing traditional, vertically integrated gas and electric utilities and independent power producers (including renewable generators) and developers in the federal, state, and local regulatory aspects of the energy business. Our extensive familiarity with the industry helps position us to tackle complex energy matters by communicating effectively with industry experts and regulators, such as the Federal Energy Regulatory Commission (FERC), the Department of Energy (DOE), the courts, and the public, and to develop practical approaches to help in achieving your business objectives.

FERC

We represent clients across the energy spectrum in a variety of matters at FERC and the DOE, as well as in appeals from FERC decisions. We represent traditional gas and electric utilities and interconnecting generation developers, including renewable energy project developers. On the electric side, our attorneys can advise you regarding open-access transmission tariffs and market operations and market rules in various regional transmission-operated markets. In particular, our attorneys have extensive experience representing utilities in providing open-access transmission service as well as generators seeking to interconnect to the grid in transmission-constrained parts of the country. We provide full-service energy experience for permitting, compliance, and energy litigation matters. Our experience in natural gas industry matters includes representation of local distribution companies involved in natural gas pipeline certificate and rate proceedings and representation of owners and operators of natural gas storage facilities. We also can advise you regarding NERC compliance matters.

State Energy Regulation

In addition to our federal practice, our attorneys offer broad experience in handling state energy regulatory matters. We represent utilities, generators, and third-party suppliers in state regulatory proceedings across the country, including rate cases, CPCN approval proceedings, transmission siting proceedings, and default service plan proceedings.
