Foley hosted an hour-long Web conference addressing recent developments involving the U.S. Environmental Protection Agency (EPA)’s enforcement program, including:
- The September 30, 2007 Washington Post front-page story suggesting the Bush administration has curtailed EPA’s criminal enforcement efforts
- The October 9, 2007 multi-billion-dollar settlement with American Electric Power (AEP), one of many recent and pending New Source Review (NSR) “global” settlements by EPA and the United States Department of Justice
- EPA’s new National Enforcement Priorities for the next three years, announced October 12, 2007
Foley attorneys who represent clients in environmental criminal matters reviewed the status of EPA’s current criminal enforcement efforts and discussed how the Ninth Circuit’s recent W.R. Grace opinion may impact corporate executives. Next, Foley attorneys representing clients in pending NSR settlements evaluated the controversies surrounding the AEP settlement. They also reviewed the global settlement process and present pros and cons in pursuing these settlements. Finally, the program discussed EPA’s new three-year enforcement priorities and outline steps that companies might take to minimize their chances of being the subject of enforcement action.
