We recently hosted a Foley Executive Briefing Series program discussing practical steps for efficiently managing electronic evidence. The program outlined five ways to train employees to manage electronic documents so that the documents can be retained or purged without risk of sanctions. Attendees learned effective options for retaining necessary e-mails while purging the overwhelming wave of nonessential chatter as well as advice for selecting and managing the array of vendors in the field. The program also addressed methods for implementing, monitoring, and ending a litigation hold without reinventing the wheel each time.

- Jon P. Christiansen is a Partner and Chair of Foley’s Litigation Specialties Group. He serves on the firm’s Training Committee and heads the firm’s electronic evidence training. His experience includes preliminary injunctions, trials, arbitrations, and appeals throughout the United States in commercial, distribution, and trade secret cases.
- Mark F. Foley is a Partner and member of Foley’s General Commercial Litigation and Data Privacy and Security Practices. His litigation experience includes preliminary injunctions, trials, arbitrations, and appeals in a variety of cases throughout the United States. Mr. Foley also authors Digital Lex, a regular column for the Wisconsin Technology Network that addresses legal issues of interest to the technology community.

Theodore S. Jankowski is Director of Corporate Legal Services at Johnson Controls. Mr. Jankowski has been a member of the Wisconsin Bar since 1977, and his educational background includes a Masters in Engineering and an MBA. One of his corporate clients is the corporate IT group. As part of that responsibility, Mr. Jankowski has been involved in developing corporate practices for e-discovery.
