Foley presented the next installment of our Labor & Employment Inner Workings Web conference series, during which Foley attorneys discussed the Family and Medical Leave Act (FMLA).
The long-awaited final changes to the FMLA regulations have been published and will take effect on January 16, 2009. These regulations implement the military leave provisions signed into law in January 2008 relating to qualifying exigency leave and military caregiver leave. Among other changes, the final regulations modify the process for and timing of FMLA leave approval, and require employees to comply with the employer’s usual attendance or call-in procedures. These changes will require employers to modify their policies, forms, and administrative processes.
Topics that were discussed included:
- The most significant regulatory modifications
- The key revisions that should be considered for FMLA policies, forms, and practices
- How the regulatory changes can help limit misuse of FMLA
