International Patent Exhaustion in the Wake of Quanta v. LG: The Global Impact on Biotechnology & Pharmaceutical Transactions
At the LES Annual Meeting at the San Francisco Marriott in San Francisco, California, David Charapp will present, International Patent Exhaustion in the Wake of Quanta v. LG: The Global Impact on Biotechnology & Pharmaceutical Transactions (Workshop 1-P LOSM) on Monday, October 19 from 2:30 pm – 3:45 pm.
Courts have become more actively engaged in patent issues that are on the legislative table. The U.S. Supreme Court’s issued decision in Quanta Computer v. LG Electronics, related to patent exhaustion, will significantly affect how Life Sciences companies structure deals and licenses as well as how they procure their patent rights. This session will analyze the court ruling and how it affects IP and patent law. Additionally, the speakers will discuss possible strategies companies might employ in light of Quanta including limiting rights to the licensee, targeting licensee customers and end users for licenses, creating clearer contractual obligations, exploring claim drafting alternatives and employing indemnification clauses.
