As with any change in administration, in addition to the new leadership, there are always new policies and new approaches. For the Jackson EPA, air regulation is one area slated for major change.
Foley’s Environmental Regulation attorneys presented Tightening the Reins Under the Clean Air Act: The Jackson EPA Approach, an insightful discussion and analysis of the Jackson EPA’s recently announced major new greenhouse-gas (GHG) rulemaking actions. Foley attorneys presented several examples of how the EPA is implementing new processes for involving the public in decision-making and issuing significant Clean Air Act policy changes outside the context of the regulatory process.
Topics included:
- New GHG-rulemaking actions
- Final rule on emissions monitoring and reporting
- Proposed rule for “tailoring” of GHG New Source Review and Title V requirements
- SEC reporting implications
- Methods used to develop or implement policies outside of the rulemaking arena
- Use of blogs for public comments
- Decisions on Title V/Prevention of Significant Deterioration (PSD) permit objections as tools for policy positions
- “Reconsideration” as a policy tool
