Bilski – Same-Day Perspectives From the November 9, 2009 Supreme Court Hearing
On November 9, 2009, the U.S. Supreme Court will hear the oral arguments in response to an appeal concerning the parameters of determining patent eligibility in a case that will impact all technology areas — from software, financial services, and insurance, to biotechnology industries. With the final decision not due until mid-2010, this hearing will provide the first critical insight into whether the Supreme Court will significantly narrow or expand the scope of the patent eligibility under 35 U.S.C. § 101.
In-house corporate counsel, an amicus brief writer, and Foley counsel provided a rare immediate post-hearing perspective on the arguments made to the Supreme Court on November 9. During this interactive installment of our Patent Nation Web Conference series, our speakers conveyed key insights from the oral arguments and provide practical steps for moving forward while the final decision awaits.
Discussion topics included:
- What is the trend among the oral arguments presented to the Supreme Court and what does it imply for present applications?
- What are the likely outcomes of the 2010 Supreme Court decision?
- Whether the scope of patent eligibility is narrowed or broadened by the Supreme Court, what is the impact for business method patents — past, present, and future?
- Until the Supreme Court decision arrives, what practical strategies can be employed in drafting claims that recite patent-eligible subject matter?
