• Several recent judicial decisions curtailing EPA’s new source review (NSR) enforcement authority and pitfalls that may remain for sources despite these rulings


• The status of the “Cross-State” rule as it awaits U.S. Supreme Court review, and EPA’s recent policy pronouncements regarding pollutant transport in the interim


• The status of EPA (and D.C. Circuit) consideration of numerous petitions regarding the new “boiler MACT” and “CISWI” rules issued in 2013


• The status of EPA’s plans to regulate greenhouse gas (GHG) emissions from new and existing power plants and our thoughts on what those rules might look like
