Electronic Health Record (EHR) Technology: Fraud & Abuse Risks and Compliance Strategies
We will address the key findings of the December 2013 and January 2014 Office of Inspector General reports on EHR fraud safeguards and vulnerabilities. Our presenters will share compliance risks identified by and strategies learned from audits, investigations, and criminal and civil cases. Additionally, we will highlight the “meaningful-use” audits and ways for organizations to sufficiently document their attestations to satisfy meaningful-use requirements for certified EHR technology.

Lori has more than 22 years of dedicated health care consulting and public accounting experience. She has participated in consulting engagements for the private sector and not-for-profit organizations. These included overall responsibilities as project manager for regulatory compliance monitoring of integrated hospital, multi-specialty clinic, single specialty clinics, mental health and community health centers, forensic reviews, operational and revenue bench marking projects, revenue cycle assessments, operational reviews and risk assessment of physician groups and integrated systems. Lori is also the leader of the firm’s Medical Group Health Care Consulting Group and member of the firm’s Health Care Executive Committee. - Judith A. Waltz, Partner, Foley & Lardner LLP
Judith A. Waltz is the former co-chair of the Foley Life Sciences Industry Team, and former vice chair of the Health Care Industry Team, and is also a member of the Government Enforcement, Compliance & White Collar Defense and Bankruptcy & Business Reorganizations Practices. Before joining Foley, Ms. Waltz was Assistant Regional Counsel for the Department of Health and Human Services. Ms. Waltz regularly advises clients who are the focus of government investigations and other enforcement actions, and has negotiated false claims act settlements with the U.S. Department of Justice as well as corporate integrity agreements (CIAs) with the Office of Inspector General. She also provides ongoing compliance counseling and Medicare and Medicaid payment advice to clients, which include county health systems, hospitals, durable medical equipment suppliers, clinical laboratories, dialysis companies, skilled nursing facilities, ambulance companies, pharmacies, managed care providers, and a variety of other health care entities. - Richard K. Rifenbark, Partner, Foley & Lardner LLP
Richard (Rick) K. Rifenbark is a member of the firm’s Health Care Industry Team and the Government Enforcement, Compliance & White Collar Defense Practice. Mr. Rifenbark’s practice focuses on health care fraud and abuse issues, including counseling on the federal Anti-Kickback Statute and Stark law, creating and implementing compliance programs, conducting internal investigations, responding to government enforcement actions, and negotiating settlements for various types of health care providers. He also counsels clients regarding the creation of EHR donation programs, as well as qualification for Medicare and Medicaid incentive payments for the meaningful use of certified EHR technology under the HITECH Act.
