Six Months of Success: A Judge’s View on Developments at the Unified Patent Court
In June 2023, the highly anticipated Unitary Patent (UP) and Unified Patent Court (UPC) officially got underway, covering 17 participating countries of the European Union. Respectively, the UP and UPC allow for a new validation option and single patent right for European patents granted on or after the Unified Patent Court Agreement went into force, plus an exclusive jurisdiction to oversee the enforcement and revocation of UPs wherein a single court ruling is directly applicable across all EU member states that have ratified the UPC Agreement.
After so many years in the making, now that the UP and UPC have been fully operational for six months, how have they been received thus far — are stakeholders availing themselves of the new court and unitary patent effect and are they serving their intended purpose?

Michael Fleuchaus, UPC Technical Judge
Michael Fleuchaus was appointed to the Unified Patent Court in June 2023 as a technical judge focused on physics, having obtained a degree in technical physics from the Technical University of Munich. He also holds qualifications in nonlinear optics and imaging techniques as well as biophysics. Additionally, Michael is a qualified German and European patent attorney at the Munich-based law firm, Fleuchaus & Gallo, where he has 20 years of IP legal experience across diverse technology areas.
