Foley Associate Adam Losey authored an article that appeared in Computerworld on May 18, 2011 titled “E-discovery: Combing the Cloud for the Information You Need.” Losey discusses how to handle legal preservation when dealing with electronically stored information, noting that preservation in this regard is difficult because most people are not adept at properly sorting, storing and categorizing the mountains of data that are created. He adds that any business using a cloud model to store electronic information needs the ability to quickly archive, copy and preserve data. Whether in or out of the cloud, Losey notes that businesses should commit resources to managing information in order to avoid legal consequences associated with poor information management.
