Foley Partner John Douglas and Of Counsel Mark Neuberger authored an article published in the Miami Herald on December 18, 2011. In the article titled “What if Occupy Wall Street protests impact your business,” the authors discuss the Occupy Wall Street movement and how business owners can respond if the movement appears at their workplace. Douglas and Neuberger say that business owners have the right to call police if non-employees enter the workplace to protest but point out that employees protesting at the workplace may be protected by federal law. Although the National Labor Relations Act generally prevents employers from disciplining employees engaged in “protected concerted activity,” the authors add that such activity can lose its protection when employees engage in egregious misconduct.
