EPA's New Coal Combustion Residuals Rule: A 745-Page Deferral With a 12,400-Ton Surprise
Partner Richard Stoll authored an article published in Bloomberg BNA: Daily Environment Report on March 12, 2015, titled “EPA’s New Coal Combustion Residuals Rule: A 745-Page Deferral With a 12,400-Ton Surprise.” In the article, Stoll traces EPA’s twists and turns on the issue over the past few years, and describes how the White House inter-agency review process blocked EPA Administrator Jackson’s preferred approach for a proposed rule. He predicts – since the long-awaited rule merely “kicks the can down the road” on the most fought-over issue – more rulemaking on the horizon unless Congress intervenes.
