This segment will focus on some of the recent rules and updates for health care reform, as well as a few items you should be aware of for the near future.
- U.S. Supreme Court's DOMA Decision
The Supreme Court has ruled that the federal government, including the IRS, must honor state laws on same sex marriages. We will discuss what employers should be doing with their retirement and health plans as a result.
- US Airways, Inc. v. McCutchen — Have You Reviewed Your Subrogation Provision Recently?
Every plan administrator should carefully review the specific language of the subrogation provision in its health plans in light of the Supreme Court’s most recent decision addressing the availability of equitable relief under Section 502(a)(3) of ERISA. The decision further underscores the difficulty that a divided Court has had providing useful guidance on the limitations on a plan’s rights under Section 502(a)(3).
