Lacktman Comments on Talkspace’s Offer to Indemnify Out-of-State Therapists Who Run Afoul of Insurers or State Regulators
08 October 2020
Partner Nate Lacktman was quoted in a CNBC article, “Internal Talkspace memo illustrates challenge of delivering virtual mental health services in 50 states,” about the online therapy provider’s offer to indemnify therapists who treat out-of-state patients for denied insurance claims and legal appearances before state regulatory boards.
Lacktman, who chairs the firm’s national Telemedicine & Digital Health Industry Team, warned that therapists who take Talkspace up on its offer could end up in trouble. “They could get something on their record that follows them across the various state medical boards, and worse, unlicensed practice is a crime in a number of states,” he said.
