Kenneth Broodo Quoted on Federal Laws Surrounding Tracking Employee Vaccination Information

Foley Partner and litigation attorney Kenneth Broodo was quoted in a SHRM article, “Vendors Roll Out Tracking Tools to Help HR Comply with OSHA Vaccine Rule,” about best practices and legal considerations regarding the tracking and managing of employee vaccination records.
Broodo said, “Vaccine tracking is permissible under federal law regardless of whether your vaccine policy is mandatory or voluntary—and apps can be used to track vaccination status.” He added, “Vaccine status information should be treated confidentially and separately filed, like any other employee medical record. The best apps will allow for employers to access vaccine and test status while maintaining the information in separate, secure electronic files.”
