Rachel Goodman Discusses the Importance of Compliance Plans for Telehealth Companies

Foley & Lardner LLP Partner Rachel Goodman is quoted in the Inside Health Policy article, “Telehealth Companies Need Compliance Plans, Lawyers Stress,” discussing the importance for telehealth companies to develop adequate compliance plans.

Goodman explained that compliance plans are often required before a telehealth company can begin billing insurers, and that some investors require a compliance plan as part of their due diligence checklist, which can lead to a scramble to create one at the last minute.

“You’re excited, you’re going to be able to start billing insurance and then you see those 150 pages, or 20-page agenda attached to it,” she said. “One of which requires a compliance program.”

As the telehealth industry experiences a high volume of M&A activity, venture funding rounds, and scrutiny from federal and state regulators, Goodman said, “There’s going to be some kind of intensive looking under the hood of how the operations work, which is one of the additional reasons why having a good compliance program is so important.”

“It will ensure that whenever this due diligence inevitably occurs, you’re going to be ready to respond to it,” she added.
