Foley & Lardner LLP partner Kyle Hayes is quoted in the Law360 article, “Tax Bonus Rules Create A Clean Energy Contracting Crunch,” offering insight on how labor and manufacturing requirements in the Inflation Reduction Act have ramped up negotiations between clean energy developers and the engineering, procurement and construction (EPC) firms and other contractors hired to build their projects given how significantly compliance can impact the value of a project’s tax credits.
“It’s just a lot of back and forth,” Hayes explained. “Even more so, I’ve seen EPC contractors have a lot of angst about the satisfaction of domestic content requirements…if they actually have to procure equipment themselves.”
