The workshop will utilize a fact pattern, specifically developed by for this event by AIRROC and Foley. The facts have been modeled on real-life disputes to ensure that delegates have as realistic an experience as possible.
The day will begin with the delegates “eavesdropping” on an unrehearsed phone call between representatives of the ceding company and reinsurer. During that call, the two company representatives will do their best to convince one another (and the workshop participants) about the correctness of their respective positions. At the conclusion of this session, the participants will be divided into reinsurer and ceding company “teams” and will be given time to evaluate the strengths and weaknesses of their positions. During this caucus period, the teams will identify their goals and devise their strategies for resolving the dispute. The teams will then be paired up for negotiation sessions aimed at resolving (or at least narrowing) the dispute. Foley lawyers and AIRROC faculty members will be on-hand to act as a resource for the teams on an as needed basis.
Delegates will come together at the lunch break for a round-table discussion between industry professionals regarding the tools that they and their colleagues are currently using to improve efficiencies and reduce costs with respect to the resolution of disputes. Topics covered will include alternative fees, project management, budgeting, and internal/external partnership arrangements.
Following lunch, the delegates will eavesdrop as the mock dispute that they have been dealing with on their own is submitted to a hearing in accordance with the AIRROC Dispute Resolution Procedure. Delegates will listen in as interlocutory issues, and then the merits of the dispute itself, are argued and submitted to the sole umpire for resolution. The delegates will then participate in a wrap up Q&A session to discuss their experiences and compare notes regarding their attempts to resolve the dispute via negotiation and how those results measure up to the outcome of the mock hearing.
