Foley Partner Harold Wegner was quoted in an article titled “In Rare Move, Federal Circuit Overturns Lower Court’s Sanctions” in the February 10, 2010 issue of The National Law Journal. Wegner discusses the Federal Circuit’s decision to overturn sanctions against intellectual property law firm Kaplan Gilman & Pergament and software company ResQNet.com Inc., stating that it is rare for the Federal Circuit to overturn a sanctions order. He adds that it is unusual to reverse a judge on sanctions, given that the appellate standard is an abuse of discretion standard.
