Gardere Represents Snuffer's Restaurants Inc. in Intellectual Property Suit

The Dallas Business Journal spoke with Gardere Bankruptcy and Business Reorganization Partner Stephen A. McCartin about the most recent legal battle between Snuffer Restaurant Inc.'s new owner Firebird Restaurant Group and Snuffer's former, founding owner Pat Snuffer.

Firebird filed claims against Pat Snuffer, his son, Mike Snuffer, and operating associate Steve Cole, claiming that the group's new concept, Pats Burgers & Cheddar Fries, is an imitation of the original Snuffer's and could cause consumer confusion. Firebird claims it owns the intellectual property, business opportunities and proprietary information of the brand. "It's just a legal maneuver for the Firebird group to try to acquire the restaurant that they didn't," Mr. McCartin said. "I don't think they truly believe there's confusion."
