Partner Michael Matthews was quoted in a Healthcare Finance News article published on April 16, 2014, titled “Warding Off Fraud Suits After CMS Physician Payment Revelations.” The article explains that lawyers, employees or former employees of healthcare organizations may begin to review recently released data on Medicare payments to doctors looking for unusual billing trends, which could generate more healthcare fraud lawsuits and whistleblower allegations under the False Claims Act (FCA). Matthews was quoted saying, “As an FCA defense litigator, I would argue that nobody is going to be able to use this data alone to bring a claim that they otherwise would not be able to bring, but they are going to try, and certainly where they have other direct and independent knowledge.”
