Partner Jeanne Gills was quoted in an Inside Counsel article, “Spider-Man, the Supreme Court and Patent Licenses,” on April 2, 2015. The article discussed Supreme Court case Kimble v. Marvel Enterprises and the impact the case has on collecting royalties once a patent license expires.
Gills was quoted saying, “While both sides advanced credible positions in their briefs and at argument, Respondent Marvel’s position appeared to be the one that resonated the most with the Justices. As Justice Kagan pointed out earlier, there needs to be “special justification” to overrule Brulotte otherwise statutory stare decisis applies and the decision must stand.”
